Terms of Service

1. Acceptance of Terms

By accessing or using Gilery (website: gilery.onrender.com or Android App), you ("User") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must immediately stop using the platform.

These Terms constitute a legally binding agreement under the Indian Contract Act, 1872.

2. Service Description

Gilery is an AI-powered local product search tool. It uses publicly available map data and AI inference to suggest which nearby shops may carry a searched product. Gilery:

• Does not maintain any inventory database
• Does not have agreements with any shops
• Does not guarantee product availability at any suggested location
• Is provided as an informational aid only — always verify with the shop directly

3. Ghost Chat — Special Terms

Ghost Chat is an ephemeral anonymous messaging feature. By using Ghost Chat, you additionally agree to the following:

• You are at least 18 years of age, OR using this feature with the knowledge and consent of a parent/guardian if between 13–17 years
• All messages are automatically deleted within 30 seconds. Gilery bears no responsibility for content sent via Ghost Chat
• Ghost Chat is provided as a privacy communication tool — it does not guarantee absolute anonymity against all forms of surveillance (e.g., government lawful interception)
• Gilery is an intermediary under Section 2(1)(w) of the IT Act, 2000 and is not liable for user-generated content, subject to compliance with Section 79
• Ghost Chat must not be used to harass, stalk, threaten, or harm any person

4. Prohibited Uses

The following uses are strictly prohibited and may result in immediate termination of access and/or reporting to law enforcement:

• Any activity illegal under Indian law including but not limited to the IT Act 2000, IPC/BNS, POCSO Act 2012, or any other applicable statute
• Sending or sharing obscene, pornographic, or sexually explicit content — including any content involving minors (violates POCSO 2012 and Section 67B IT Act)
• Harassment, stalking, threatening, or intimidating any person
• Spreading false information, impersonation, or defamation
• Any activity that violates another person's privacy or dignity
• Using the platform to facilitate terrorism, extremism, or any form of violence
• Attempting to hack, reverse-engineer, or disrupt the platform
• Commercial scraping or automated abuse of the service
• Cheating on a spouse or partner — while Gilery does not monitor content, we strongly discourage any use that causes emotional harm to others

5. Intermediary Status & Safe Harbour (IT Act Section 79)

Gilery operates as an intermediary under Section 79 of the Information Technology Act, 2000. Accordingly:

• Gilery is not liable for any third-party content, including messages sent via Ghost Chat, provided Gilery acts in good faith and within the bounds of its intermediary obligations
• Gilery complies with the IT (Intermediary Guidelines) Rules, 2021, including publishing these Terms and Privacy Policy, and having a designated grievance mechanism
• Upon receiving a valid court order or government direction, Gilery will cooperate with lawful authorities to the extent technically possible and legally required
• Users acknowledge that even ephemeral services may be subject to lawful interception orders under Indian law

6. Disclaimer of Warranties

Gilery is provided on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

• AI-generated shop suggestions are probabilistic estimates only and may be inaccurate
• Gilery does not guarantee uninterrupted, error-free service
• Ghost Chat's auto-delete mechanism is best-effort; Gilery cannot guarantee deletion in all failure scenarios (e.g., server crash)

7. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Gilery and its Developer shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from use of the platform
• Loss of data, privacy breach caused by a third party, or unauthorised access beyond our reasonable control
• Actions taken by users in violation of these Terms
• Reliance on AI-generated search results that prove inaccurate
• Any emotional, reputational, or financial harm arising from misuse of Ghost Chat by other users

Our total aggregate liability, if any, shall not exceed INR 0 (zero), as Gilery is a free service provided without any commercial consideration to the user.

8. Intellectual Property

All content, design, code, and branding of Gilery are the intellectual property of the Developer, protected under the Copyright Act, 1957 (India). You may not copy, reproduce, distribute, or create derivative works without prior written permission.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of India. Any disputes arising shall be subject to the exclusive jurisdiction of courts in Ghaziabad, Uttar Pradesh, India. For international users, Indian law applies to the extent permitted by their local jurisdiction.
